Virtual office and Chamber of Commerce: is that allowed and what should you look out for?

What is a virtual office?

With a virtual office , you get a business address at a real location without having to work there daily. You use the address on your website, in your email signature, and for your mail. You work from home, on the go, or at various locations. At Frame Offices, there is usually more to it. Can you use a virtual office as a Chamber of Commerce business address?

This is the question at the heart of the matter in practice. Since the Chamber of Commerce (KVK) tightened the rules as of January 1, 2022, it no longer accepts a PO box number as a business address. A business address must be a physical location where business activities can actually take place. To prove this, you must be able to demonstrate a lease, sublease, or usage agreement. A bare PO box or letterbox address does not meet this requirement.

A virtual office with a real visiting address aligns better with the Chamber of Commerce's expectations than a separate PO box. This is especially true if you can also make use of facilities such as a day office or meeting room. However, this ultimately remains an individual assessment. The Chamber of Commerce actively checks whether companies are actually reachable at the provided address and whether actual activities are taking place. Mailing address or business address: the difference

These two terms are often used interchangeably, but are not the same.

  • A mailing address is intended exclusively for receiving mail and can be provided alongside your actual business address.
  • A business address is the official address at which your company is listed in the Commercial Register and where your business is actually established.
  • For most freelancers and small businesses, it is practical to have both coincide at the same location, so that mail and registration belong together.

For whom is a virtual office with Chamber of Commerce registration interesting?

A virtual office is particularly attractive to freelancers and small businesses working from home. They do not want to make their private address public in the Commercial Register or on their website. Entrepreneurs just starting out often choose this route as well, as they do not yet want to invest in a permanent office. The same applies to companies that want to demonstrate their presence in a new city. You get a representative address in a prime location, without the costs and obligations of a fixed office.

What do you need to register at a virtual office?

Do you want to register your business at the address of a virtual office? In that case, the Chamber of Commerce usually requires proof that you are actually authorized to use it. In practice, this involves the following points.

  • A signed agreement with the provider stating that you may use the address for your business.
  • Permission from the owner or main tenant of the property, usually arranged by the provider themselves.
  • A valid proof of identity and the other information that the Chamber of Commerce routinely requests for registration.
  • If in doubt about your specific industry or activity: a quick check with the Chamber of Commerce to see if your type of business has additional address requirements.
